Long-term residence permit for the purpose of study in the Czech Republic Abstract Long-term residence permit for the purpose of study is permitted by the Ministry of the Interior to the third-country nationals who intend to stay in the Czech Republic for more than 1 year. The fundamental legal regulation governing long-term residence isact No. 326/1999 Coll., On the Residence of Foreign nationals in the Czech Republic and on amendment of certain acts, that is transposing Directives of the European Union on which is this residence based. The case law of the Czech administrative courts, the Constitutional Court and the Court of Justice of the European Union cannot be omitted since it is important source. Firstly, is the master's thesis devoted to the concept of foreigners, in order to clearly specify for which category of foreigners is the long-term stay intended to and what area of law deals with it. Subsequently, the Directive 2004/114/EC, which is the basis of a valid and effective regulation of the study stay, is being analysed along with the Directive 2016/801, which will be transposed into the Czech legal system by an amendment to act No. 326/1999 Coll., which is at the time of submitting the master's thesis at the stage of the government's draft, waiting for the first reading in the Chamber of...

Application proceedings for long-term residence permit for business purpose

The aim of this thesis is an interpretation on the administrative procedure concerning an application of the third-country nationals for long-term residence permit for business purpose on the bases of the act nř 326/1999 Coll., On the residence of foreign nationals in the Czech Republic and about amendment of certain acts. The thesis is divided into four parts. The first part contains the interpretation of key terms (foreign nationals, long- term residence permit and business purpose) which determine the long-term residence permit for purpose in question. The second part deals with conditions to be met for submission of the application form and on requirements needed to be attached to the application form. The third part deals with the administrative procedure after submission of application form focusing on particularities of application proceedings for long-term residence permit for business purpose. The fourth part asses the issuing of final decision.

Stay of the third-country nationals in the Schengen Area in the common visa policy framework

The thesis deals with the development of the Schengen cooperation and characteristic of the Schengen acquis transforming in the course of time, with the stress on the field of visa and residence/migration policy. Main emphasis is on the valid legislation concerning the status and stay of the third country nationals. The thesis looks into problematic parts of the legislation, both theoretical and practical, and provides opinion of the author on those matters. The thesis is divided into four main spheres. The first one concerns development of a visa and migration policy in the framework of development of the Schengen cooperation and its gradual integration into the main EU policies, its definitions and different participation of the Member States. Following key part of the thesis deals with the current valid provisions of the stay of the third country nationals (citizens of the countries outside of the EU). This part defines subjects of law coming from the third countries, as differentiated by the Union and Czech law and defines various types of authorization to stay which entitle them to short or long-stay at the Schengen or Czech territory.
